• Use the Software in compliance with applicable educational regulations

2.3 Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the Software
• Remove or modify any copyright notices or license information
• Distribute, sublicense, or resell the Software
• Use the Software for illegal or unethical purposes
• Circumvent license activation or copy protection measures

3. Payment and Subscriptions

3.1 Pricing

• Monthly subscription: $8.99 per month
• Annual subscription: $89.00 per year
• Prices subject to change with 30 days notice
• All prices in USD unless otherwise specified

3.2 Payment Terms

• Payment is due in advance for the subscription period
• Auto-renewal can be cancelled at any time
• Refunds available within 30 days of purchase
• Failed payments may result in service suspension

3.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You retain access until the end of your billing period
• Your data remains on your device and accessible
• No refund for unused portion of subscription period
• You may reactivate at any time

4. Your Data and Privacy

4.1 Data Ownership

You retain complete ownership of all data you create, import, or store in Markers Helper. This includes but is not limited to:

• Student information and grades
• Rubrics and grading criteria
• Comments and feedback
• Reports and analytics

4.2 Data Storage

All your data is stored locally on your device. We do not have access to, store, or process your grading data on our servers. See our Privacy Policy for details.

4.3 Data Backup

You are responsible for backing up your data. While Markers Helper includes backup features, you should maintain your own backup procedures to prevent data loss.

5. Acceptable Use

5.1 Educational Purpose

Markers Helper is designed for legitimate educational grading purposes. You agree to use the Software in compliance with:

• Applicable educational privacy laws (FERPA, COPPA, etc.)
• Your institution's policies and procedures
• Professional ethical standards for educators
• All applicable local, state, and federal laws

5.2 Prohibited Uses

You agree not to use Markers Helper to:

• Violate any laws or regulations

• Store or process sensitive data outside your intended use
• Attempt to circumvent software security measures

6. Software Updates and Support

• We may provide updates, patches, and new versions
• Updates may be automatically installed for security reasons
• Major version upgrades may require additional payment
• We reserve the right to discontinue support for older versions

6.2 Support

• Support provided during business hours via email and support portal
• Response time: 24-48 hours for standard issues
• Priority support available for annual subscribers
• Support limited to Software-related issues

7. Disclaimers and Limitations

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL EXTENSIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR BUSINESS INTERRUPTION.

7.3 Maximum Liability

Our total liability to you for any claim arising from these Terms or your use of the Software shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

8. Intellectual Property

Markers Helper, including its code, design, documentation, and trademarks, is owned by Digital Extensions and protected by intellectual property laws.

You retain all rights to content you create using the Software, including rubrics, comments, and reports you generate.

• Cancelling your subscription
• Uninstalling the Software
• Ceasing all use of the Software

• Fail to pay subscription fees

• Attempt to circumvent license restrictions

9.3 Effect of Termination

• Your license to use the Software ends immediately
• Your data remains on your device
• You should uninstall the Software
• Surviving clauses (payment obligations, disclaimers) remain in effect
